HQ Club Membership Terms and Conditions
- Introduction
Welcome to the HQ Club, a membership programme offered by High Quality Garden Solutions (“the Company”, “we”, or “us”). These Terms and Conditions (“Terms”) govern the HQ Club membership and outline the rights and obligations of members and the Company. By registering as an HQ Club member or using any HQ Club benefits, you agree to comply with these Terms. The HQ Club is designed to provide our customers with exclusive benefits that make garden maintenance more convenient, hassle-free, and cost-effective (HQ Club – High Quality Garden Services). Through priority support, special pricing, service credits, and seasonal offers, HQ Club ensures that your garden receives high-quality care at unbeatable value all year round (HQ Club – High Quality Garden Services). These Terms apply in addition to our standard service terms (for individual gardening services) and do not replace any statutory rights you may have as a consumer.
- Membership Eligibility & Registration
- Eligibility: HQ Club membership is open to individuals (homeowners, tenants, or business clients) who utilise our gardening services within our service area in the United Kingdom. You must be at least 18 years old to join. Membership is intended for personal use in relation to properties you own or occupy (or manage, in the case of business customers). We reserve the right to refuse membership to any applicant who does not meet these criteria or for any other reasonable cause.
- Registration Process: You can apply for HQ Club membership through our website or by contacting our team. The simplest way to join is to select the HQ Club option when booking a gardening service with us. For example, when you book a service and choose to join HQ Club, an annual membership fee of £89 will be added to your total (HQ Club – High Quality Garden Services), and you will immediately receive membership benefits on that booking (such as an instant discount on the service) (HQ Club – High Quality Garden Services). Membership is activated once we have received the required payment and you have agreed to these Terms. After registration, you will be provided with confirmation of your membership (e.g. a welcome email or message) and an account in our system reflecting your HQ Club benefits (including available service credits). Each individual or household is allowed only one HQ Club membership account, and memberships are not transferable (see Section 6 below for restrictions on transfer).
- Membership Term: HQ Club membership is annual. Each membership term lasts for twelve (12) months from the date of activation (the date your membership fee is paid and processed). For example, if you join on 1st January, your benefits will run through 31st December of that year, unless renewed. There is currently no monthly or trial membership plan – only the annual membership is available (HQ Club – High Quality Garden Services). We do not automatically renew your membership without your consent (see Section 4 on Renewal); however, we may send a reminder as your renewal date approaches.
- Membership Benefits
As an HQ Club member, you will enjoy a range of exclusive benefits throughout your membership term (HQ Club – High Quality Garden Services). These benefits are designed to reward your loyalty and enhance your experience with our services. The core membership benefits include:
- Service Credits (Discounts): Upon joining HQ Club, you receive £250 worth of service credits in your HQ Club account (HQ Club – High Quality Garden Services). Each credit is equivalent to £1 in value (HQ Club – High Quality Garden Services). You can apply these credits as a £25 discount on the price of up to 10 different service bookings (25 credits per booking) (HQ Club – High Quality Garden Services). In other words, for each of the first ten services you book during your membership term, £25 will be deducted from the total fee for that service. This provides you up to £250 in total savings across multiple gardening services (HQ Club – High Quality Garden Services). Credits are applied at the time of booking or payment and will be reflected in your invoice or receipt. Credits have no cash value (they cannot be exchanged for cash) and can only be used as discounts on eligible High Quality Garden Solutions services. Unused credits remain in your membership account until used or until the membership expires, whichever comes first (see Section 6 for credit usage limitations and expiry).
- Priority Booking & Response: HQ Club members receive priority status for service scheduling and inquiries. This means we strive to offer you faster response times and priority access to reserved booking slots for our gardening services (HQ Club – High Quality Garden Services). When you request a service, we will give your booking request precedence, making it easier to secure a convenient time even during busy periods (HQ Club – High Quality Garden Services). In urgent situations or peak seasons, HQ Club members also receive expedited attention – your garden needs come first, and our team will make reasonable efforts to accommodate last-minute or urgent service requests with priority (HQ Club – High Quality Garden Services). Please note that while priority booking increases your chances of preferred scheduling, it is not an absolute guarantee of any specific date or time; scheduling remains subject to crew availability and weather conditions.
- Exclusive Seasonal Deals: Members unlock access to special seasonal offers and promotions throughout the year (HQ Club – High Quality Garden Services). These exclusive deals may include discounted packages, bundled services, or other promotions tailored to each season’s gardening needs (for example, spring planting packages, summer lawn care bundles, autumn clean-up specials, or festive holiday garden décor services) (HQ Club – High Quality Garden Services). Seasonal deals are offered only to HQ Club members as an extra perk and will be communicated via email, our website, or member newsletters. Each seasonal offer may have its own terms (such as validity period or limited availability), which will be indicated when the offer is announced. Members are not obliged to use any seasonal deal, but the option is there to enjoy additional savings and services that non-members would not have access to.
- Preferential Member Rates: In addition to the credit-based discounts, HQ Club members benefit from exclusive member pricing on many of our popular gardening services (HQ Club – High Quality Garden Services). This means that certain services may be offered to members at lower base rates than our standard prices for non-members. We continually strive to provide preferential rates and the best value for members as part of the HQ Club programme (HQ Club – High Quality Garden Services). (For instance, if we introduce a new service or package, we may offer it at a special price for HQ Club members.) All such member-only rates or discounts will be clearly identified when you receive a quote or book a service. These preferential rates, combined with the use of credits, ensure you receive outstanding value for money on our most in-demand services (HQ Club – High Quality Garden Services).
- Referral Rewards: HQ Club members can earn additional credits by referring friends or family to High Quality Garden Solutions. If you refer a new customer who joins HQ Club or books their first service with us using your unique referral code, both you (the existing member) and the referred friend will receive a bonus of 10 credits each as a reward (HQ Club – High Quality Garden Services). (10 credits equals £10 in service discount value.) The credits from referral will be added to your HQ Club account once the referred person has completed their first paid service. Referral credits are subject to a fair use policy: the referred customer must be genuinely new to us, and abuse of the referral system (such as self-referral or creating fake accounts) is prohibited (see Section 6 on member conduct). There is no limit to how many friends you can refer, but referral rewards are only granted for those who actually become customers. Referral credits, like regular credits, have no cash value and expire if not used during an active membership. We reserve the right to modify or discontinue the referral programme at any time, but any earned credits will remain valid according to these Terms.
- Additional Perks: From time to time, we may introduce new benefits or special promotions exclusively for HQ Club members. This could include first access to new services, free minor add-on services (for example, a complimentary plant health check during a visit), members-only content such as gardening tips newsletters, or invitation to special events. We will inform members of any new perks as they become available. All HQ Club benefits are provided at our discretion and may be adjusted to improve the programme’s value. Rest assured that the overall package of benefits will remain substantial and worthwhile, as our goal is to reward loyal customers with meaningful value and excellent service (HQ Club – High Quality Garden Services).
- Fees & Payment
- Membership Fee: The HQ Club membership is subject to an annual fee. The current price for a one-year membership is £89 (this amount may be inclusive of VAT or any applicable taxes) (HQ Club – High Quality Garden Services). The fee amount is reviewed periodically and is subject to change for future membership periods (see “Renewal” below). The £89 fee grants you membership benefits for a full 12-month term. When joining, this fee is charged upfront at the time of registration (e.g., added to your first service booking total or paid separately if you sign up without an immediate service) (HQ Club – High Quality Garden Services). By paying the membership fee, you purchase a 1-year HQ Club membership which commences from the payment date.
- Payment Methods: We accept various payment methods for the membership fee, including major credit/debit cards. Payments can be made through our online booking/checkout system or via invoice link provided by us. In certain cases, we may also accept bank transfers or other payment arrangements (if agreed in advance). All payments must be made in Pound Sterling (GBP). You will receive a receipt or invoice confirming your membership fee payment. If any payment is not successfully processed (e.g., due to card issues), the membership will not be activated or will be suspended until the issue is resolved. You are responsible for providing complete and accurate billing information and keeping us updated if your payment details change.
- Renewal: HQ Club membership is not automatically renewed by default. Prior to the expiry of your 12-month term, we will endeavour to notify you (via email or other contact details provided) that your membership is coming up for renewal. To continue enjoying HQ Club benefits without interruption, you will need to actively renew your membership by paying the membership fee for the next year. We will inform you of the renewal process and any changes to the fee or terms at that time. If you do not renew by the membership expiry date, your HQ Club benefits will lapse at the end of your current term. Note: If we ever introduce an optional auto-renewal service in the future, it will be communicated clearly and require your explicit consent. Unless and until such an option is offered and consented to, you are responsible for renewing your membership each year.
- Fee Changes: We reserve the right to adjust the annual membership fee for future periods. Any change in membership pricing will not affect your current active membership period (we will not alter the fee mid-term after you have already paid). New pricing would apply at the point of renewal or for new memberships. We will communicate any fee changes ahead of time, so you can decide whether to renew under the new price. If you do not agree to a new fee, you may simply choose not to renew, and your membership will end at the conclusion of your current term (or you may cancel as per Section 5 if within the initial 14-day period for new memberships).
- Cancellation & Refund Policy
- Cancellation by Member: You have the right to cancel your HQ Club membership at any time. However, the availability of a refund depends on the timing of your cancellation and the benefits you have used, as detailed below. To cancel, you should contact us by phone or email (see Section 9 for contact information) with your request. We may require a written confirmation of cancellation for our records. Once cancelled, your membership benefits will cease immediately (or on a requested future date if we agree). This means you will no longer be able to claim discounts, credits, or other perks for any new service bookings after cancellation. (Cancelling the membership does not automatically cancel any upcoming scheduled gardening services; if you wish to cancel or change a scheduled service, please inform us separately, subject to our service booking terms.)
- 14-Day Refund Period: We offer a cooling-off period of fourteen (14) days from the date you purchase or renew your membership, during which you can change your mind and request a refund of the membership fee (HQ Club – High Quality Garden Services). If you cancel within this 14-day window, you will be eligible for a full refund provided you have not utilised any membership benefits. If you have already used some benefits within the first 14 days (for example, if you applied a £25 service discount or used some credits toward a service booking), then any refund will be partial, deducting the value of benefits used from the £89 fee (HQ Club – High Quality Garden Services). Specifically, we reserve the right to subtract £25 for each service discount/credit you redeemed or any other concrete member benefit you received, and refund the remaining balance. This ensures fairness, as you cannot both use the member discounts and also receive a full refund of the fee. We will inform you of any such calculations when processing your refund. Refunds will be issued to the original payment method, unless otherwise agreed. Please allow a reasonable time for the refund to be processed by us and your payment provider.
- Cancellation After 14 Days: If you wish to cancel your membership after the initial 14-day period has passed, you may do so, but no refund of the membership fee will be provided. Your membership will remain active until the date of cancellation, after which all benefits will terminate. (For example, if you cancel on the 6th month of your membership, you will not receive a prorated refund for the remaining 6 months.) However, you will still keep any benefits already used; we will not ask for reimbursement of credits or discounts you legitimately used while you were a member. Essentially, after 14 days, the membership fee becomes non-refundable, so please be sure you wish to continue with the membership beyond the cooling-off period. If you are unsure, we encourage you to make use of the initial period to evaluate the value of HQ Club.
Termination by the Company: We reserve the right to terminate your HQ Club membership early in certain circumstances:
- If you commit a serious breach of these Terms or misuse the membership benefits (for example, fraudulently obtaining discounts, sharing your benefits outside your household contrary to the rules, or other misconduct), we may terminate your membership with immediate effect. In such cases of breach or misuse, you will not be entitled to any refund of the membership fee, and any unused credits or benefits will be forfeited. We will provide notice of termination and the reason for it.
- If at any point we decide to discontinue the HQ Club programme entirely or for your specific service area, or if operational circumstances require us to cancel memberships, we will provide you with as much advance notice as possible. In the event that we cancel your membership through no fault of your own (for example, because we are ending the programme or can no longer serve your area), we will refund the unused portion of your membership fee on a pro-rata basis. For instance, if we discontinue the programme halfway through your membership year, we would aim to refund approximately half of your fee (i.e., £44.50 out of £89) to compensate for the unused half-year, minus any benefits already used if applicable. Alternatively, we may offer equivalent value through completing any pending discounted services or other adjustments – we will communicate options in such scenario.
No Refund on Expulsion: If your membership is terminated due to violation of these Terms or any unlawful or inappropriate conduct on your part, you forfeit any claim to a refund, including for any unused credits. We also reserve the right to invoice you for any benefits used inappropriately or costs incurred due to your breach (for example, if fraudulent use of credits caused losses to the Company). Such measures will only be taken in extreme cases.
Cancelling your HQ Club membership does not automatically cancel any ongoing agreements you have with High Quality Garden Solutions outside of membership. If you have, for example, a separate contract for regular garden maintenance, that contract remains in effect unless separately terminated. Membership is a supplemental service agreement.
This cancellation policy does not affect any statutory rights you have. For instance, if you qualify for any statutory right of cancellation or refund under consumer protection laws beyond what is offered here, those rights remain intact. We believe our policy (full refund within 14 days if unused, etc.) is aligned with UK consumer law on service cancellations and is intended to be transparent and fair.
- Use of Services (Member Conduct & Responsibilities)
When using HQ Club membership benefits and our gardening services, members are expected to adhere to the following guidelines and responsibilities to ensure a smooth experience for both you and the Company:
- Personal Use of Membership: HQ Club membership and its benefits are for your personal use (or use by your household) in connection with services provided by High Quality Garden Solutions. Membership is non-transferable – you may not sell, gift, or assign your membership or benefits to anyone outside your household (HQ Club – High Quality Garden Services). You are allowed to book a service on behalf of a member of your household using your membership (for example, a spouse or family member living with you) (HQ Club – High Quality Garden Services), but all benefits must be applied to services for properties that are owned or occupied by you or your immediate family. The membership account remains in your name, and you are responsible for any use of your membership benefits by your household. You may not share any login credentials or membership identification with others outside your household. If we suspect that membership benefits are being shared improperly or outside of these terms, we reserve the right to investigate and take appropriate action (which may include suspension or termination of membership).
- Booking Services with Membership: To use your HQ Club benefits, you must book services through the usual channels (our website, phone, or email). When booking, identify yourself as an HQ Club member (if booking by phone/email) or ensure you are logged into your member account or use the same contact details associated with your membership so that your benefits can be applied. Service Credits will be automatically applied to eligible bookings – up to 25 credits (£25) per service booking – as long as you have credits remaining. Credits can only be applied once per distinct service appointment and up to ten appointments in total during your membership term (HQ Club – High Quality Garden Services). You cannot combine credits on a single service to exceed the £25 per service limit, nor can you exceed your total allotment of £250 in credits per membership term. If you attempt to book more than ten services in the year, the first ten bookings would receive the £25 discounts (using all £250 credits), and subsequent bookings in that term would be charged at normal member rates (without further £25 credits, since the credits would be exhausted). If a service booking is cancelled in line with our cancellation policy (for the service itself), any credits that were applied to that booking will be returned to your HQ Club account provided the service had not been delivered. However, if our team already delivered part of the service or incurred costs (e.g., arrived on site) before cancellation, we may consider the credit used for that booking. We encourage members to schedule services thoughtfully and give sufficient notice if rescheduling or cancelling, to make the most of your benefits and to allow us to serve you best.
- Priority Service Requests: As a priority member, when you request service, we will make a good-faith effort to prioritise your booking. This means you should generally expect shorter wait times for appointments or quicker turnaround on quotes/responses. However, you acknowledge that on occasion, factors beyond our control (such as extremely high demand, weather events, staff shortages, etc.) may prevent us from offering an earlier slot, even for members. We will inform you of the earliest available times and keep you updated. Members are expected to cooperate with scheduling by providing us with a reasonable range of availability when requesting service. The more flexibility you have, the easier it is for us to fit you in with priority.
- Exclusive Deals Usage: When we announce a seasonal deal or special promotion exclusive to HQ Club members, any specific instructions or terms for that deal will be provided (for example, how to redeem the offer, the timeframe, and any limitations on combining with other benefits). Members are responsible for following the stated instructions to redeem these deals (such as quoting a code when booking or clicking a special link). Unless explicitly stated, membership-exclusive discounts or deals can typically be combined with your service credit (meaning you could use your £25 credit on top of a discounted seasonal package price). If there are any restrictions on combining offers, we will make that clear in the promotion details.
- Conduct During Service Delivery: When receiving services from our team as an HQ Club member, you are expected to uphold the same standards of conduct as any customer. This includes: providing accurate information about the job requirements, ensuring safe and adequate access to your garden or premises at the appointed time, supervising any pets or children to avoid interference with the work, and treating our staff with courtesy and respect. Abusive or inappropriate behaviour towards our staff is not tolerated and may result in termination of services or membership. If you have any special requirements or concerns (e.g., gate codes, parking instructions, fragile garden areas, etc.), you should communicate these when booking. Members should also comply with any specific instructions or guidelines given by our team for safety (for example, if we advise against using part of your garden for a short period after a treatment, or similar). By adhering to these responsibilities, you help us maintain a high standard of service for you and ensure your garden gets the best care.
- Fair Use of Benefits: The HQ Club benefits are provided in good faith for genuine use by our loyal customers. Any attempt to abuse the membership – such as deliberately scheduling excessive services purely to use up credits in a manner not consistent with actual need, engaging in fraudulent referrals, or manipulating bookings – is prohibited. We define fair use in line with normal residential or commercial garden maintenance needs. If we detect patterns of usage that suggest misuse (for example, an implausibly high number of small service bookings made just to claim discounts, or multiple membership accounts at the same address), we reserve the right to inquire further and potentially suspend benefits until resolved. We aim to be reasonable and will discuss any concerns with you first. Our primary goal is to ensure the HQ Club remains beneficial to both our clients and our business sustainability.
- Combination with Other Offers: HQ Club benefits are generally exclusive to members and separate from any public promotions we run. If we do have a public sale or discount, HQ Club members might either (a) receive that public discount on top of membership benefits, or (b) already have a better deal via membership so the public offer may not apply. We will clarify on a case-by-case basis. By default, assume that your HQ Club discounts cannot be combined with other coupons or discounts unless we confirm otherwise. This is to prevent “stacking” multiple promotions that could exceed reasonable limits. Our booking system or staff will apply the best available option for you – which, as a member, will usually be your HQ Club benefit. If you ever have questions about how a price or discount was calculated, please contact us for clarification.
- Member Account Details: If the HQ Club involves an online account or unique membership ID, you are responsible for keeping your login credentials confidential and for all activities that occur under your account. Ensure that any password or codes are secure. Notify us immediately if you suspect any unauthorised use of your membership or if your membership confirmation email/details are lost or stolen. We are not liable for any loss of credits or benefits arising from unauthorised access due to your failure to safeguard your information. We can assist in resetting account access if needed. (If the membership does not use a login system, this may not apply—currently, membership is managed by our team in our system, so this point is more precautionary.)
- Compliance with Laws: You agree to use the HQ Club membership and our services only for lawful purposes. Any illegal, fraudulent, or harmful activity in relation to membership or the use of our services will be grounds for immediate termination of membership and possibly reported to authorities if appropriate. This includes adhering to any local restrictions (for example, if there are local council rules about garden waste disposal or noise times for garden work, etc., we expect you to not ask us to violate those and to obtain any necessary permissions—though we typically handle compliance as part of our service).
- In summary, as a member you should use the HQ Club benefits in the spirit they are offered: to enhance your garden maintenance experience. Treat our team with respect, follow booking procedures, and enjoy the perks responsibly. We will reciprocate by providing top-notch service and support to fulfil our end of the membership offering.
- Liability & Disclaimers
- Service Quality: We commit to delivering our gardening services with reasonable care and skill, in accordance with good industry practice. HQ Club members do not receive a different standard of workmanship (all customers receive high-quality service), but you do receive priority and discounts as described. While we strive to keep your garden in excellent condition, we do not guarantee specific outcomes or that your garden will look a certain way, as gardening results can depend on factors outside our control (such as weather, soil conditions, plant behavior, etc.). Any service-specific guarantees (for example, a guarantee that weeds treated will not regrow for a set period) will be as per our general service terms or provided in writing for that particular service. The HQ Club membership itself is not an insurance policy or warranty for your garden; it is a package of benefits to help you save money and get priority service.
- Limitation of Liability: To the fullest extent permitted by law, High Quality Garden Solutions (and its owners, employees, and agents) shall not be liable for any indirect, incidental, special, or consequential losses or damages arising out of or in connection with your HQ Club membership or the services provided. This includes, for example, any loss of enjoyment of your garden, loss of use, loss of business or opportunity, inconvenience, or emotional distress that may result from delays, scheduling issues, or our services. Our total liability for any claim related to the HQ Club membership (e.g., a claim relating to a failure to provide a benefit) is limited to the amount of the membership fee you paid for the current membership term. In terms of the gardening services themselves, our liability for any claim relating to a specific service visit (e.g., property damage or incomplete work) is limited to the amount you paid (after any HQ Club discount) for that particular service, unless otherwise required by law.
- We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be lawfully limited or excluded under English law. Your statutory rights as a consumer (such as rights under the Consumer Rights Act 2015) are not affected by these Terms.
- Service Availability: While HQ Club aims to provide priority access, we do not guarantee that a particular service will always be available or that we can always attend at the exact time you request. There may be occasions (due to extreme weather, unforeseen staff illness, equipment failure, or other force majeure events) when we have to reschedule or cancel a service appointment, even for members. We disclaim liability for delays or failure to fulfill a booking in such circumstances beyond our reasonable control, but we will communicate with you promptly and reschedule as soon as possible. Similarly, if a particular membership benefit becomes unavailable or impractical to offer (for instance, if a supplier stops offering a product that was part of a seasonal deal, or if changes in law prevent a certain discount structure), we reserve the right to modify or substitute that benefit with something of equivalent value. We will notify you of any such changes (see Section 8).
- No Guarantee of Savings: The HQ Club membership is designed to save you money on our services (up to £250 in credits per year, plus other deals). However, the actual savings you achieve will depend on your use of the services. If you do not make use of your credits or benefits, your potential savings may not be realised. We make no refund or compensation for unused benefits (except as part of a timely cancellation as described in Section 5). It is your responsibility to take advantage of the benefits provided. We encourage you to schedule regular garden maintenance or make use of the seasonal deals to maximise the value of your membership.
- Third-Party Services and Referrals: High Quality Garden Solutions is not responsible for any services or products provided by third parties. HQ Club benefits apply only to services we directly provide. If as part of a promotion or courtesy we refer you to a third-party specialist (say, a tree surgeon for a very large tree removal which we don’t cover), that arrangement is solely between you and the third party, and our membership discounts would not apply to their fees. We will of course aim to refer reputable professionals, but we aren’t liable for their work or any dealings you have with others outside our company. The referral program (where you refer a friend) is also an internal programme – we are not liable for any issues between you and the friend in terms of private arrangements; our obligation is simply to award the promised credits when conditions are met.
- Indemnity for Misuse: If you use the HQ Club membership or our services in breach of these Terms or in an unlawful manner, and that causes damage or loss to the Company or any third party, you may be held responsible for that damage or loss. In other words, you agree that you will indemnify (compensate) High Quality Garden Solutions for any costs, claims, liabilities or expenses incurred by us as a result of your breach of the Terms or misuse of the membership. This is not to penalise normal usage – it is mainly to protect against fraud or malicious misuse.
- No Waiver: If we fail to enforce any part of these Terms at any time, it will not be a waiver of our right to do so later. For example, if we overlook a minor breach of the rules on one occasion, it does not mean we have agreed to it or that you can continue doing it. We reserve our rights to enforce these Terms at all times.
- Severability: If any provision of these Terms is found to be invalid or unenforceable by a court or competent authority, that provision shall be severed (removed) from the agreement and the remainder of the Terms shall continue in full force and effect. In other words, the rest of these Terms will still be valid and binding.
- Changes to Terms & Conditions
High Quality Garden Solutions may update or modify these HQ Club Terms and Conditions from time to time. Reasons for changes may include: adapting to new laws or regulations, improving clarity, adjusting the membership benefits or policies, or reflecting changes in how HQ Club operates. When we make changes to the Terms, we will inform members in advance. Notification may be given via email (to the address associated with your membership) and/or by posting a prominent notice on our website outlining the changes. We will provide at least 14 days’ notice of significant changes when feasible, before the new terms take effect, unless the change is required sooner by law.
If the changes include any material reductions of your benefits or increases in fees, and you still have a significant period left in your current membership term, we will allow you to cancel your membership and receive an appropriate refund if you do not agree to the changes. Our aim is to ensure that changes do not unfairly disadvantage our members mid-term.
For minor or clarificatory changes that do not negatively impact the membership value (for instance, rewording a clause for clarity, or updating contact information), we may not offer a cancellation refund since those changes do not materially affect your rights or obligations.
Continued use of your HQ Club membership benefits after any updated Terms have come into effect constitutes acceptance of those new Terms. If you do not agree to the changes, you must notify us and (if applicable) cease using the membership or not renew at the end of your term. Always feel free to contact us if you have questions or concerns about any proposed changes to these Terms.
The latest version of the Terms and Conditions will always be available on our website for you to review. We recommend that you check back on the Terms periodically, especially if you join HQ Club far in the past, to ensure you are aware of the current Terms governing your membership.

- Governing Law & Jurisdiction
These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the HQ Club membership, shall be governed by and construed in accordance with the laws of England and Wales. By joining the HQ Club, you agree that any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. This does not deprive you of any rights under consumer protection laws to pursue claims in your local jurisdiction or small claims court where applicable, but generally any significant legal proceedings should be brought in the English courts under English law.
If you reside in Scotland or Northern Ireland, you may also have the right to bring an action in your local courts under local law, but the governing law will remain English law unless otherwise required by statutory rights. We hope, however, that any issues can be resolved amicably by contacting us as outlined in Section 9, without the need for legal action.
By purchasing or renewing an HQ Club membership, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These Terms constitute the entire agreement between you and High Quality Garden Solutions regarding the HQ Club membership programme, and supersede any prior communications or representations.
